As a former Certified Law Clerk for the Los Angeles County District Attorney, William Duffy has unique insight into the way the government handles criminal charges. Q. Got dui Didn’t complete classes Warrant issued 8 years later caught What will likely happen in court when I show up
A: Best strategy to hire a local attorney who can recall the warrant. Some courts will vacate the class, others may make you complete it now. Either way, probably no significant penalty, if any.
Q. I marsdins my court appointed public defender twice but was denied. What can I say or do he disrespects me.
A: A Marsden motion is where you complain to the court that your free appointed counsel is inadequate. A lawyer who disrespects their client should consider another career, especially one who serves as court-appointed counsel. However, disrespect is not considered in whether the attorney can competently and adequately represent you. Your best solution is to speak with the supervisor of the court-appointed counsel, such as the public defender or alternate defender's office. Many times they will assign a new attorney where a personality change would be beneficial.
Q. Can my DUI case be dismissed if I was not legally arrested. The officer stated on the supplemental/ narrative report I
A: False statements by a peace officer go to the officer's credibility at trial or motion. Assertions that the officer lied in a report can only yield a dismissal of the charges if you fight your case. The prosecutor assigned to file cases will take the officer at their word and file charges. If a warrant was issued, it probably means that you refused that chemical test. If so, you could be facing a one-year or longer hard suspension of your driving privilege. I'd need more information and would like to read the reports before rendering an opinion. It sounds like you need a good DUI attorney or you could be facing serious consequences. I suggest finding the best lawyer for the specific courthouse where your arraignment will be heard, or at least the county. A local lawyer knows the lay of the land. They know the prosecutors and the judges who will decide the outcome of your matter.
