Q. Is it my financial responsibility to repay for work that was almost done, but had to be torn out and redone?
A: For construction projects, the parties' rights and obligations are generally dictated by the terms of the contract or agreement. It will be difficult for any lawyer to answer this without reviewing your contract. Florida has a "prior breach" doctrine which can sometimes excuse one party's performance (ex: payment) when the other party materially breaches the contract first. However, it is not clear whether that doctrine would be applicable here without more information.
Q. Is it posible to recover my money ?
A: It will be difficult to answer this question without reviewing the terms of your contract (provided that you had one). Generally, the parties rights in a business transaction are dictated by the express terms of contract. If there is a breach of those terms, and damages result, a court is able to enter a judgment in the non-breaching party's favor. Also, if there is some form of deceit or fraud, that may also be a basis for recovery.
Q. Suing for money owed, but unsure of defendant's address. If he is pulled for traffic violation, will that summons show?
A: In Florida, civil summons do not appear on person's driving record in the same way as an arrest warrant. The person who is bringing a civil action is largely responsible for serving the summons themself.
