Richard Pawelczyk

Richard Pawelczyk handles transactions and litigation for individuals, as well as companies of all sizes. He has represented household names, both individuals and companies, in music, sports, fashion, food & beverage.
He was counsel to several prominent entertainment companies and helped guide their business development. Rich is also a seasoned intellectual property attorney, with vast experience in trademarks and copyrights for celebrities and media companies. He co-authored a legal brief that advocated for extension of copyright protection in a case that was before the United States Supreme Court.
Rich’s experience includes corporate transactions, commercial real estate, food & beverage, fashion, entertainment law, rights of publicity, and employment matters.
Rich helped form UmixIt Technologies with his colleagues at Columbia Records and Webster Hall, along with Aerosmith’s Steven Tyler, which won Intel’s Best New Technology Award at the Consumer Electronics Show.
Rich Pawelczyk earned his Juris Doctor from St. John's University School of Law and undergraduate degree from Stony Brook University.

- Q. Trademark My trademark is being opposed by a large company, because our names are similar. Thoughts ?
- A: Some of the other considerations include: a) how similar the marks are, b) how similar the goods & services are, c) how distinctive their mark is; d) how long they have been using their mark; e) how long you have been using your mark; f) how long if at all their mark has been registered; g) the degree of fame that their mark may have obtained; h) whether there has been any actual confusion by the public, believing that your two companies are affiliated.
