Perry Pittenger

Mr. Pittenger devotes substantially all of his practice to the representation of retail automobile dealerships in a wide variety of matters including, but not limited to, all types of consumer litigation, administrative proceedings before the New Jersey Division of Consumer Affairs, the New Jersey Motor Vehicle Commission and the New Jersey Department of Banking and Insurance. He draws upon his 25 years of experience in representing auto dealers to provide advice in connection with a number of non-litigation dealer issues such as regulatory compliance, employment issues, advertising regulations, licensing issues, vendor contracts, floor plan and retail credit relationships, finance and insurance matters and other regularly recurring issues.

Mr. Pittenger along with his partner Ted Schiller established Schiller & Pittenger in 2000 with the initial goal of being one of the very few law firms in the New York/New Jersey metropolitan area that could provide comprehensive legal advice and representation to retail auto dealerships throughout the region. Since its inception in 2000, Schiller & Pittenger has expanded significantly and it now provides legal representation in a number of areas well beyond the auto dealership arena.

Before establishing Schiller & Pittenger with Mr. Schiller, Mr. Pittenger served as Vice President and General Counsel for Toresco Auto Group, Inc. (“TAG”), a privately held management company that operated dozens of automobile franchises throughout New Jersey, Pennsylvania, Georgia and Florida. Mr. Pittenger served as Vice President and General Counsel of TAG for approximately 8 years during which time the TAG dealerships had gross annual sales of nearly $500 million dollars.

In 2005, Mr. Pittenger was retained by nearly one-third of all the new car dealerships in the State of New Jersey to represent them in the single largest class action lawsuit ever filed against the State’s new car dealers. Mr. Pittenger was a key member of the dealer defense team that ultimately negotiated a very favorable settlement of the litigation. He has also represented various regional dealer advertising associations.

Mr. Pittenger has been recognized by the New Jersey Coalition of Automobile Retailers (NJ CAR) as one of the preeminent authorities on auto dealership law in the State of New Jersey. He has been asked to speak about a variety of topics affecting the New Jersey retail automotive industry at a number of NJ CAR’s annual meetings. Mr. Pittenger, as well as other members of Schiller & Pittenger, have written a number of articles on auto dealership issues which have been published in NJ CAR’s annual magazine. Mr. Pittenger has been approved by a number of insurance companies such as Zurich, Sentry, Harleysville and Merchants, to represent auto dealerships in a wide array of litigation matters.
