- Q. What can I do if my property was foreclosed, I’m in the redemption period but the new owner is refusing to take payment
- A: You should hire an experienced Alabama attorney to navigate the process. I do not regularly handle these matters but have done so in the past.
The code of Alabama states as follows as to your comments:
"SECTION 6-5-252 DEMAND FOR STATEMENT OF DEBT AND LAWFUL CHARGES BY PERSON ENTITLED TO REDEEM.
Anyone desiring and entitled to redeem may make written demand of the purchaser or his or her transferees for a statement in writing of the debt and all lawful charges claimed by him or her, and the purchaser or their transferees shall, within 10 days after the written demand, furnish the person making the demand with a written, itemized statement of all lawful charges claimed by him or her. ... The Code of Alabama establishes certain rights in law as "Right of access to cemetery on privately owned or leased property." As with any situation you should hire a lawyer if you are in doubt about a situation.

- A: This is not legal advice as to this specific question or case you have submitted but information I believe is relevant to your question. That said you should hire a lawyer to navigate all the possibilities before you. In general, these types of cases can involve many documents a lawyer will want to view. He will need all documentation involved, including filed land records and bankruptcy filings and the payment information and any emails or writings which may have been involved to review. Depending on the value of the real estate, you would need to decide whether the cost to investigate the status by an attorney is economically feasible based on the possible property value or recovery.
