Summary

A major part of my law practice is connected to real estate - (real estate sales, both residential and commercial, property tax appeals, land use (zoning and planning boards) and landlord and tenant law). In addition, we also provide services in the areas of wills and estate administration (probate), municipal court representation (DWI and traffic offenses), income tax and business advisory services. I have found that most people excel at what they enjoy doing, I enjoy these areas of the law the most.

In addition to my law license, I was licensed in New Jersey as both a real estate agent and a certified public accountant. I concentrate my continuing legal education on these areas in order to maintain my expertise. I have over twenty years experience where I represented municipalities as a land use attorney or in property tax appeals. This gives me the unique perspective of "knowing what the other side is thinking" when I represent private clients, as well as having allowed me to forge relationships with my colleagues in these areas.

We also believe in giving back to the community. I am a member of the Loyal Order of Moose, a fomer Board of Education member, served on the Board of Directors of the Boys and Girls Club of Lodi and New Jersey Area Council of Boys & Girls Clubs. I have also coached girls softball (local and travelling) as well as girls soccer.
I am also invloved with several emergency services. I am currently the Deputy Emergency Management Coordinator for the Borough of Lodi (formerly a Deputy Coordinator for the Garfield Office of Emergency Management), an Operations Section Chief for the Bergen County Office of Emergency Management and a member of Garfield Fire Department Company 4.

I also own a couple of motorcycles which I enjoy riding as often as possible.

Q. We just found out our landlords don’t have a certificate of occupancy and they filed evictions.
A: Not necessarily. All that's required for an eviction is that the property be registered with the town as a rental property, not a current CO. However, if the unit is illegal, and the town is making the landlord evict you, then you may be entitled. As far as the security, you MAY be able to have it applied as rent. That depends upon the number of units, if it's owner occupied, and depending upon the first two answers, whether you made a request to have the law apply. Q. I received property when my father passed and selling it. I live in NJ and wondered what inhertance tax will be due
A: You didn't say whether your father was a NJ citizen. If he wasn't then NJ will not tax the property. If he was, then the property will be subject to the NJ estate tax calculation. Q. Ticket for parking on reserved space, when there is no clear sign board on reserved lot.
A: While you may have a case, the cost of the lawyer would certainly be much more than the ticket. You could try proceeding on your own, but your time has value too. You may or may not be able to convince a judge. You need to weigh this in deciding whether to fight it or not. My feeling is just pay it and walk away. Q. My uncle left me fifty percent of his house in NJ .Do I have to pay a gift tax, if it was gifted in his will
A: Gift tax is only paid on gifts made while the donor was alive. In this case, it sounds like you inherited it. There is an inheritance tax in New Jersey. The rate for class D beneficiaries (a niece or nephew falls into this class) pays a 15% tax. In addition, the estate may be liable for the NJ estate tax. Depending upon the circumstances, your share may be reduced by a portion of that tax as well. I disagree with Mr. Aalsberg on this. Q. Are the landlords responsable for car damage inside of the property that I am renting?
A: It's hard to say with so little facts. If the landlord somehow contributed to the accident by overcrowding the garage, or by putting the spaces too close together, perhaps. Q. My mother passed 2/6/17 and has some stock in her name. The beneficiary forms to make my sisters and I equal beneficiars
A: Just contact the company. They will send you the correct forms to fill out. You will likely need to fill out an affidavit of residence and provide the death certificate and letters of administration. A: You will likely need to probate your sister's estate. If she actually established residency in Illinois, that's where you will need to probate the estate. Q. If I have a DUI in NJ, can I enter Canada without issue since it is a traffic offense and not criminal?
A: This is a very common question. Canada may deny you entry if you have a DWI. So, if you're planning on going to Canada, you should address this in plenty of time prior to going.
