I was admitted to practice law in 1994, and since then the bulk of my practice has been focused on matrimonial and divorce law, appeals and closely related areas such as foreclosure defense.
My approach in representing clients is straightforward. Good people sometimes find themselves in bad situations, and people come to lawyers for solutions. That means whenever possible, negotiating a fair agreement is often the best route. Nevertheless, agreements, negotiations, litigation and appeals are only the tools used to obtain these answers. By taking a broader holistic approach, it allows me to see solutions that others may miss.
Reaching a fair agreement doesn’t always come easily, and very often a settlement can only be reached from a position of strength. That means having the ability to take a case to trial, and when necessary, an appeal. I
Many of my cases involve people facing complex legal issues. My grasp of the CPLR and ability to figure out how to use existing rules and law in novel ways is how I approach finding answers for these cases.

- Q. What do I do when my lawyer passed away right before divorce trial?
- A: First of all, your case is stayed automatically upon the death of your lawyer. See CPLR 321(c)
Many think the stay is for thirty days, but that is not correct. The other side must first make a demand and that starts the 30 days running.
The 30 days countdown also starts once you have a new lawyer. It can be extended, at the discretion of the court for a sufficient reason, such as the loss of a file due to an attorney dying.
A lawyer should know how to proceed in this situation and how to obtain time to get your file, as well as how to protect you in case that time is not given.

- A: Can you? Yes.
Will you? Maybe.
When the court divides marital property in a divorce, they are not required to split everything 50/50. Depending on the facts or each case, the judge can award one spouse a greater percentage than the other. The factors you stated could certainly be used to argue that you should obtain more than 50%.

- A: As the others have said, an RJI must be filed in every case. Its simply the form used to assign a judge to a case.
