Jose A. Ceja has devoted his career to the practice of criminal law and is honored to aggressively defend his clients. He has built a well-deserved reputation for achieving excellent results for clients throughout the Greater Houston area.

He began his career as a prosecutor in Arizona and was quickly promoted to the felony division, prosecuting drug cases.

In 2010, Jose was hired at one of Texas premier criminal defense firms Scheiner law, working closely with one of the top criminal defense lawyers in the state.

Mr. Ceja has a proven track record of obtaining outstanding results including dismissals, grand jury "no bills", reduction of charges, and acquittals.

He has chaired over 50 criminal jury trials and is never afraid to go to trial and help his clients.

Jose also assists those who are charged with DWI or drug offenses, having spent hundreds of hours studying the science of breath and blood testing. He is certified to administer Standardized Field Sobriety Tests (SFSTs).

Q. Where can I find a probono attorney in the collin county area?
A: Hello- If you can't afford a lawyer, your best bet may be to ask the court to appoint you an attorney. Typically the court will want you to fill out some paperwork swearing that you are indigent (have no money). Very few attorneys advertise themselves as "pro bono" and I think you are unlikely to find an attorney to work on your case for free that way. Good luck to you. -Jose Ceja
Q. Can I be convicted of a third degree felony on a second DWI conviction?
A: If no special aggravating circumstances are being alleged (for example, that someone was seriously injured in an accident resulting from your alleged DWI), and you are charged with regular DWI, then the State needs to prove that you have two prior CONVICTIONS. You can be charged with third-degree felony intoxication assault even if you have no priors.
Q. Can my 3rd degree felony DWI charge be reduce Class A misdemeanor?
A: A DWI third can be reduced to a Class "A" misdemeanor. This isn't uncommon at all. It will help if you don't have significant criminal history and lawyer has a good plan for attacking the evidence. Often, you won't get an offer like this unless your lawyer is willing to set the case for trial. Your question was whether it can be reduced "during" trial. It can be if the State can't prove your priors. The State must prove during your trial that you have two prior DWI convictions.
