- A: In addition to Attorney Beckert's comment you may want to check with the probate court which has jurisdiction over the town where you lived to see if such an estate was opened on your behalf and, if so, follow up with that court to determine the status. - A: A person who knows the deceased does not have the legal authority to file a wrongful death claim. An estate must be opened for the deceased and the administrator of the estate generally has the authority to then file such a claim.

- A: Your questions raises more questions. Yes, it's possible to settle a case within 6 months. Whether you should do so depends on the nature of your injuries, the liability of the involved drivers, and the willingness of the insurance company to resolve the matter.
