- Q. Statute of limitations expired for medical care?
- A: There are Statute of Limitations (SOL) in Florida specifically for work comp cases. One of those is that you have to see your doctor every year. If you don't, your case may be closed. HOWEVER, there are ways around violating the SOL meaning your case would still be open if one or more of them applies. It is very fact-specific and on a case-by-case basis. Of course work comp won't tell you about that though, and this is why I'd highly recommend that you reach out to an attorney licensed in Florida and who handles workers' compensation cases to help with this.
- Q. my attorney had received an offer which was a 1/4 worth the value of the at faults claim coverage my attorney
- A: Your case's value is based on its damages. Damages encompass past & future medicals, wages/earning capacity, and pain and suffering (sometimes punitive/punishment damages, but that's rare). However, pretty much all damages are primarily based on the medicals meaning the more treatment you receive/have recommended, typically, the value of the case increases more. You can't be forced to get medical care that you don't want or need; it's ultimately up to you. You should ask your attorney to explain the process better if you don't understand.
- Q. I’m currently on floridas Workmen’s Compensation and my doctor has cleared me for modified work. If I want to refuse the
- A: You can get therapy even if you refuse to return to work, which only really affects to getting work comp checks. However, before you refuse the job that was offered, I'd highly recommend that you speak to an attorney licensed to practice law in Florida and who handles workers' compensation cases to talk about your options.
