Dawn Padanyi is a graduate of Mount Holyoke College and Syracuse University College of Law where she was the Co-Director of the Grant Opportunity Program and a member of the Community Development Law Clinic While at Syracuse, Ms. Padanyi was chosen to receive two grants to perform legal work at the local and state level. Ms. Padanyi is a Pennsylvania and Massachusetts licensed attorney. She is a member of the Bucks County Bar Association as well as the Pennsylvania Bar Association. She is also proud to be selected to serve on the Board of Directors for the Bucks County Bar Association. Prior to founding the Law Office of Dawn Padanyi, she practiced law at a couple of large firms in Center City Philadelphia then relocated to practice at a Bucks County law office in Doylestown, Pennsylvania. Ms. Padanyi regularly volunteers her legal services to help indigent clients throughout Bucks County.

Q. At what does the child have the right to say what parent they want to live with. My daughter is 15.
A: Stability is an important factor for children. No lawyer, without knowing all the information about your case, will be able to answer if you will get primary physical custody in Court. If you cannot afford a lawyer, you may look into Legal Aid as it is still best to have an attorney assisting you. Many counties also have a discount program as well. You should at least consider having a consultation with a local attorney to give you a preliminary assessment of your case. Lastly, there is not a specific age when children can decide child custody, however, generally the older the child is, the more weight the Court attaches to the child's opinion.
Q. with physical and legal custody of my son. Can I withhold him from mother on her day for visitation?
A: If you have a court order concerning custody of your child then those are the terms that must be abided by for both people. If either parent is not in compliance with the court order then it could bring about a contempt proceeding in which the court could sanction a party for his or her violation of the order. If the current order is no longer appropriate in your opinion then you should consult with a local attorney about possibly modifying the order through the court. I advise that you schedule a private consultation with a local attorney.
Q. Can my mother sue me for visitation rights to her granddaughter?
A: The answer to your question is maybe. The area of grandparents rights regarding child custody act is very fact specific, hinging on the type of contact that the grandparent is seeking and the status of her relationship to the child prior to the filing.
