- Q. How to prevent grandmother's visitation rights after I moved to South Carolina?
- A: Are there any prior orders of custody/visitation in New York? If not & if you've been residing in S.C. for more than 6 months, then S.C. would have jurisdiction over any conceivable grandparent visitation issue. If that's not the case, however, then you should schedule a consult with a NYC Child Custody Attorney for a full assessment & evaluation of your case.
- Q. How can I locate my daughter after her mother moved her to Puerto Rico without custody agreements?
- A: You would need to hire a P.I. in an attempt to locate her. Neither the Courts nor lawyers can assist you with that process. Bear in mind, however, that if they've been residing in P.R. for more than 6 months, then P.R. may have jurisdiction over any custody issue. Schedule a consult with a NYC Child Custody Attorney for a full assessment.
- Q. How can I transfer a family case from Brooklyn to Westchester, NY, where my child and I reside?
- A: When you say "There are no existing custody or support arrangements in Brooklyn to consider," I assume you mean there are no court orders addressing those issues. If there's pending cases on such issues, then it may depend on how far along those cases are. If there are no prior court orders & no pending cases, then simply file a Petition in Westchester. Schedule a consult with a Westchester family Law Attorney for a full assessment.
