Q. My only income is worker's compensation. In VA, is my comp income and everything obtained with it exempt in bankruptcy?
A: Yes, your earnings obtained through Workers' Compensation are exempt from execution by creditors based on the statute you reference. Since the Commonwealth of Virginia does not allow its citizens to use the federal exemptions, the benefit is clear that Virginia's protection of Workers' Compensation from creditors will also apply to a bankruptcy case. Further, if you are garnished at your bank or the party who pays the Workers' Compensation, you may argue this exemption in a garnishment proceeding. It is probably best to simply contact an attorney and file for a bankruptcy case as the bankruptcy will fully and finally deal with any outstanding debt obligations. Q. If I'm given 60 days to move out, do I have to move on day 60, or if I leave before, do I have to pay till day 60?
A: According to the notice law in your jurisdiction, you must be out of the property by the end of the 60th day. Additionally, you must pay rent through the 60th day. If you do not leave, you can be sued for unlawful detainer and eventually be kicked out forcibly by the County Sheriff. It is suggested that you follow this notice and move prior to the expiration of 60 day period. Good luck in your future.
Q. My name is only on the mortgage my ex husband is not. but we are both on the deed. He wants to buy the condo.
A: The simple answer is that he cannot take your name off the mortgage. He needs to refinance to take your name off the mortgage. There is an old strategy whereby he can assume the mortgage but this takes the approval of the mortgage company. The mortgage company would, however, still want to keep you on the mortgage for the property and would not agree to the assumption. Good luck in this matter and resolving it to your satisfaction.
