Q. Inadequate settlement for injury from airplane tire at husband's work.
A: As a general rule, settlement agreements are binding. However, there are exceptions. If the settlement was a result of a workers' compensation claim and your husband was represented by an attorney, I recommend speaking to his attorney or contacting another workers' compensation attorney for a second opinion to determine if the settlement is binding or if it can be cancelled. If your husband is not represented by an attorney, the judge of compensation claims will review the settlement and determine whether it is in the best interest of your husband. In this instance, the settlement may be void.
Q. Would I still receive lost wage payments after being terminated if I was cleared to return to work under light duty?
A: It does not appear that you were terminated for misconduct and your employer does not have work available within your restrictions, therefore, I think you should still be receiving lost wage payments from workers comp unless you have reached overall maximum medical improvement (MMI).
Q. Question about Florida Workers Compensation Lawyer MSA settlement
A: Yes. The law allows an attorney to be paid a percentage of any benefits secured and an MSA is a benefit secured for, and on behalf of, the injured worker.
