Brian M. Latuga dedicates his practice to Criminal Defense in State and Federal courts. He is a skilled trial attorney, a 2nd Amendment advocate, and is well-versed in a variety of fields. Brian became a Police Officer in 2005 and served with both the Virginia Beach Police Department’s Third Police Precinct and its Traffic Safety Unit. During his policing career Brian made hundreds of criminal arrests, conducted well over 400 DUI investigations and issued thousands of summonses. He is certified and proficient in RADAR, LIDAR, Commercial Motor Vehicle Weighing, the Alco-Sensor FST (the Preliminary Breath Test), Advanced Crash Investigations, Interview and Interrogation Techniques, and Advanced SWAT. He was a licensed operator of the current DUI breath alcohol instrument for over six years. Brian has a thorough working knowledge of police training, certifications, tactics, procedures and the intricacies of criminal law.

Brian is also a former Senior Assistant Commonwealth’s Attorney with the City of Virginia Beach. In both judge and jury trials Brian has litigated nearly all crimes, including Involuntary and Voluntary Manslaughter, Assault and Battery- Law Enforcement, Larceny, Burglary, Robbery, Malicious and Aggravated Malicious Wounding, Rape, Robbery, DUI-Manslaughter, DUI-Maiming and Murder.

Brian graduated 2nd in his class from Regent University Law School - summa cum laude. As a former EMT-Intermediate, VBPD Officer, and Senior Assistant Commonwealth’s Attorney, Brian will exceed your expectations.

Q. Under current law, if a loved one is convicted of second degree murder, do they qualify for earned time credits?
A: They should qualify for the 85%/86% credit unless it’s a very old offense where parole applies.
Q. Can someone use a voice recording as evidence in Va without the other person knowing they are being recorded
A: I’m criminal cases, generally yes. In other types of cases- divorce- generally, no.
Q. I have a protective order against me. I need to know my legal rights as we live in the same house
A: If there are no exceptions, then you likely must leave the house and have no contact. Your lawyer should be able to read the order and explain it to you. You may be able to have it modified pre-hearing if the petitioner is willing.
