- Q. How to protect myself if someone falsely claims I stole millions given as a gift?
- A: The quick/short answer is Forensics. Records will be key to battling this accusation and you must prepare yourself for whats coming around the corner. This will also help you if there are any secondary reporting issues (taxes) if a regulatory agency will be motivated to look more closely into the gifts you received. Several of my own clients each had to approach their cases very specifically due to their facts. A very detailed and involved consultation is your best bet.
- Q. How to avoid arrest from false accusations by spouse?
- A: This will pretty much come down to the accusations themselves, and what your spouse claims to the investigating officers. Domestic abuse has a wide range of factors and this alone could trigger an arrest. So long as the recordings you have (which we are assuming were made while your spouse was aware of being recorded) support the opposite of what you're being accused of, this will help prevent prosecutors from filing. Even if a filing were to come to fruition, your records may help. But the bottom line here is that there is very little you can actually do to prevent an arrest. This will always depend on the accusation and any evidence that can support it.
- Q. In California how far back does a live screen background check go?
- A: For any license or credential given by an agency in CA, any livescan will pull up a person's entire criminal history as it is stored in the DOJ repository. However, agencies prefer to see cases that have been expunged or sealed for dozens of reasons. If the 2 misdemeanors and DUI you have in your past simply expired after probation ended, then I highly encourage you to petition the courts to clear the convictions so that your livescan appears the best way possible as you obtain your license.
