Austin M. Lux is an attorney in the Colorado Springs area specializing in Criminal Defense. Austin attended law school at the University of Denver where he focused on litigation and was an assistant editor for the 2016 edition of the Colorado Evidence Courtroom Manual, a popular reference manual utilized by judges and practitioners throughout the state.

After graduation, Austin joined Colorado's 4th Judicial District where he served for four years as a Deputy District Attorney. During his tenure as a District Attorney, Austin handled cases ranging from DUIs and domestic violence charges to aggravated felonies and vehicular homicides. Austin was a member of the Southern Colorado Drug Task Force and the office's liaison to the Drug Enforcement Administration.

Since transitioning into private practice, Austin has focused on utilizing his intimate understanding of the legal system and skills as a trial attorney to advocate for his clients in court.

Q. Possession of fire arm
A: Colorado defines possession for the purpose of the Possession of a Weapon by a Previous Offender statute in the following way:

"Possession constitutes a “voluntary act” if the actor was aware of his physical possession or control thereof for a sufficient period to have been able to have terminated it."

Not surprisingly, there is no clear answer in that definition. These cases are highly fact-specific and can go either way depending on where the gun is located and who can access it. Long story short, it's a significant risk being anywhere near a firearm after receiving a felony conviction.

A: The charge that you accused of is a class 2 misdemeanor traffic offense. It carries a possible penalty of 10-90 days in jail and/or a fine of $150-$300.
