Biography

I am a criminal defense attorney. That is all that I do. I do not dabble in other areas of law. I solely practice criminal defense. Whether your case requires a jury trial, plea negotiations, or appellate advocacy, I have done all of these things effectively and continue to do them on a daily basis. Criminal charges have serious consequences that can follow a person for life. I strive to have a close connection with all of my clients to ensure that they feel comfortable and are always fully informed about their case. I encourage my clients to ask questions and to call me if they are unsure about anything. When my clients call me, unless I am in Court, I actually answer the phone and call them back promptly. This includes calls at night or on weekends. If you are my client, you will have my cell phone number. You will not continuously reach my voicemail or a secretary. The choices that my clients and I make about their cases are important and I insist that my clients are active participants in their defense. I strive to provide them with candid and well informed advice that comes from working in this field for the past twelve years. I am licensed to practice in Missouri and Illinois. Although the bulk of my practice is in and around the St. Louis area I routinely travel to other jurisdictions in each state. Q. In St. Louis mo is 60 days in jail on a class c felony domestic , first offence, no prior record.
A: The answer is maybe. It will depend on your judge, your prosecutor, your jurisdiction and most importantly your lawyer and the specific facts of your case and whether you have a prior record.

Your attorney should be able to give you a decent estimate as to whether it is or not.
Q. Does property damage in the first degree have to be proven malicious or do accidents count too?
A: Malicious is not the right word. But the State would have to prove "intent to damage property". If it was truly an accident, that would be a plausible defense to the charges. However, that would depend on the specific facts of your case.

People get in car accidents every day and do not get charged with crimes because they are only accidents and nobody was intentionally trying to hit another car.

Please make sure you have an attorney that can explore that defense with you as property damage in the first degree is a felony in the state of Missouri.
Q. I have not been conficted did the have the right to ca my doc and talk about my charge ?
A: Unfortunately bonds often have conditions. If it is a drug charge, often times the defendant will be subject to random UA testing at a private probation office as a condition of your bond. Make sure you don't have any dirty drops or your bond could get revoked.

If you have a lot of clean ones and stay out of trouble while the case is pending try speaking to your attorney about filing a motion to amend the conditions of your bond so that you do not have to report as often. It may work if the judge sees that you have been doing a good job with no violations.
