- Q. Legal steps for compensation due to ink-contaminated eggs causing illness.
- A: Since you don't have any medical evidence that the ink caused you are illness, your case is essentially worthless. Your opinion about the cause of your illness is not admissible. People get nausea for a large number of reasons, completely unrelated to ink. Further, the amount of ink an a shell is tiny. The amount that "seep[s] into the pores" is even smaller. The belief that such a tiny amount of ink would cause 3 days of illness is probably unfounded. Finally, egg shell printing requires food grade ink, which is safe to consume and won't cause illness unless you are somehow allergic.
- Q. Can I sue for defamation if falsely accused of assault by a hotel guest in California?
- A: Yes, this is grounds for a defamation suit. Given the apparent history of the accuser, it seems that the statements might be intentionally false rather than just mistaken identity. In that case, her homeowners insurance, which might cover defamation would probably deny coverage based on intentional misconduct. You would then be in the position of trying to recover from her personal assets, which is something that no personal injury attorney likes, as the prospect of payment diminishes by a massive amount. - A: Verify whether your employer had workers’ compensation insurance at the time of your injury. California law requires all employers with at least one employee to carry workers’ compensation insurance or be self-insured.
Contact the Workers’ Compensation Insurance Rating Bureau (WCIRB) or visit the California Workers’ Compensation Coverage website to confirm your employer’s insurance status. If the employer was self-insured, check the roster of self-insured employers on the Office of Self-Insurance Plans (OSIP) website.dir.ca.gov
