Todd B. Kotler
Arnold, Gruber & Haren, Ltd.
Since 1999 I have labored to establish divorce settlements that are firm but fair and parenting-time schedules that work. Relocating and long-distance parenting plans. I resolve high-conflict situations, protective orders, and deal with parental alienation. I also have litigated a number of high value cases in both Summit and Stark Counties.
My firm also has handled a great number of high value transactions involving mineral rights, land leases and easements with energy companies. We have done joint ventures, partnerships, S corporations, LLCs, commercial and industrial developments, condominium developments or conversions and office building sales and purchases. Likewise, I have drafted construction contracts, lease negotiation and preparations, loan workouts and foreclosures as well as sale and purchase contracts.
Notably, I am among a handful of Ohio Attorneys who practice special education law. My focus in this area is on the parents of special needs children. I aid them in ensuring that these children receive the free and appropriate public education (FAPE) that each child is guaranteed under state and federal law.

- Q. In the state of Ohio can your friends parents kick your friend out when 18 and still in high school(current junior)?
- A: Tricky question. Technically a parent has an obligation to parent a child until they emancipate. That usually happens when the child is both 18 AND a high school graduate. This may be further complicated if a parent is receiving child support on behalf of that child. This question does not contain enough facts to give a more complete answer. Is this a matter of both parents asking their 18 year old child to leave? Why is this occurring? My recommendation would be to have this student reach out to the counseling resources at the high school.
- Q. My neighbor has a situation. She has her children living with her but her ex husband still has an order for child
- A: She and the ex need to file a joint entry (with the judge's signature) modifying the parenting plan to reflect this new situation. Once that is in place she needs to contact CSEA and provide a certified copy of the filed entry to them requesting the modification of the support award.
- Q. Started common law marriage in Montana moved to Ohio and continued filing all taxes as married 15 years total.
- A: In order to fully answer this question, one would need to know whether or not the couple described map of the criteria for common law marriage in Montana when they moved to Ohio. Ohio has not recognized common law marriage (within the state) since 1990. If, however, the couple met all the criteria for Montana before they moved out of that state, Ohio would recognize it.
