Hi! I’m Tiffany Ballenger Floyd, Las Vegas Estate Planning Attorney.
My practice areas include all aspects of Wills & Trusts and Estate Planning, Asset Protection (including design and formation of Nevada Asset Protection Trusts), as well as work with Nevada LLC and Business Formation, Planning and Maintenance. I also help clients with drafting and negotiation of Premarital and Post Marital Agreements. I am licensed to practice in both Nevada (2008) and California (2007). I'm proud to serve as a Pro Bono Children's Attorney with the Legal Aid Center of Southern Nevada, which provides representation to abused/neglected children in the Las Vegas area foster care system.

- Q. What is the difference between being an interested person in a trust and a non interested person.
- A: Interested "person" may be the grantor (creator) of the trust, a trustee and/or a beneficiary. Interested "trustee"- The term Interested Trustee means a Trustee who: is a transferor or beneficiary; is related or subordinate to a transferor or beneficiary; can be removed and replaced by a transferor with either the transferor or a party who is related or subordinate to the transferor; or can be removed and replaced by a beneficiary with either the beneficiary or a party who is related or subordinate to the beneficiary. For purposes of this Subsection, transferor means a person who transferred property to the trust during that person’s lifetime, including a person whose disclaimer resulted in property passing to the trust. A person is only a transferor during his or her lifetime. Beneficiary means a person who is or may become eligible to receive income or principal from the trust under the terms of the trust, even if this person has only a remote contingent remainder interest in the trust, but not if the person’s only interest is as a potential appointee under a power of appointment. - Q. In the state of Nevada, will filing a Homestead Exemption do anything if our home is in our Living Trust?
- A: Nevada homestead exemption protects the equity in your primary residence (w/ proper homestead filing) up to $550K- cheap & easy protection! A revocable living trust typically does not provide ANY asset protection to the creators of the trust, so it's probably wise to file your homestead. It can be done when a home is owned by a revocable trust.
