- A: Well, first off, anyone could sue for anything. The actual question is whether you will be successful. In my opinion, you would not be successful. In order to be successful you have to prove that the party against whom you are making a claim was negligent. First of all, you dropped the sauce on yourself so that was your own contributory negligence. But more importantly, Sauce is meant to be hot and you were surely aware of the fact that it was hot and so you have your own duty to be careful. I do not see any negligence on the part of whomever provided you with the pizza sauce, whether it was a restaurant, or a heated up frozen food. - A: Taking a photograph of your license plate is certainly legal. To prove assault, he would have to prove intent to harm. This sounds more like a simple, negligence action. If your car accidentally hit a structure, your liability insurance should cover the damage. Simply report the accident to your Insurance as soon as possible and if that person has a claim, they can put it through your insurance. Unless you intended to harm the person, I would not see this as an assault. Assault is a criminal charge and they would have to go to the police to report it .
- Q. Can a personal injury case in supreme court be heard after 30 yrs? I have a 1,000,000 suite against the city of NY
- A: Well first of all, go on the court website and make sure that your case is marked ‘active’ and not ‘disposed’ which would be a problem. If it’s ‘disposed’ it means the case is closed and then someone would have to contact the court to get it re-opened. Unless of course, there was a dismissal or settlement which are generally the reasons a case would be ‘disposed.’
Secondly, you are absolutely entitled to your file and should insist on it.
Finally, you are not obligated to use any particular attorney and once you get the file you can have it reviewed by an attorney of your Choice to then see who you want to use.
