Q. What is the US Civil Statute to be stated in a Negligence, Negligence Per Se, Complaint for Damages?
A: In general, negligence is a "common law" doctrine and not a statutory cause of action. However, California does have a negligence standard set forth in California Civil Code 1714.
Q. Car hit while legally parked - can't get police report. Can't get car fixed.
A: If you have collision coverage, your insurance should cover this incident.
Q. I the the persons insurance is taking full 100% lieablity how much is the pay out for my car and my self
A: This depends upon a lot of factors. For your car: the standard is the lesser of "fair market value" or the cost of repair. If the cost of repair exceeds fair market value, your vehicle is deemed a "total loss" and the value of the car is owed. As to how insurance companies calculate "fair market value": Most auto insurance carriers use "market surveys" to determine an average based upon the make, model, year, mileage and condition of your car compared to similar vehicles that have sold in the area in the past 6-12 months. For your injuries: You are entitled to the reasonable value of the medical services necessary to treat your injuries. You are also entitled to "general damages" for the physical pain and emotional distress that the incident caused.
Q. I was injured and in auto accident and their inuance issayig that they 100%at fault
A: You should seek prompt medical attention and retain a personal injury attorney. Just because the insurance company for the other driver is accepting "100% liability", does not mean they will compensate you fully for your injuries. Having a personal injury attorney to obtain medical records and bills and properly document and present your claim is essential to obtaining full and complete compensation.
Q. My brother took my car without asking and got into an accident.
A: Report the claim to your insurance carrier immediately. You are not obligated to speak with the insurance company for the other side.
Q. 2007 I was given a serious brain injury, I developed a serious brain disease 6 years later, can anything be done
A: Unfortunately, you would need to provide some additional information. The normal deadline for filing a personal injury claim in California is 2 years from the date of the incident that caused your injury but, delay in diagnosis is possible. Consult with an attorney immediately on any potential claims.
Q. On the highway a motorcycle in front of me wiped out
A: Possibly. From what you describe, it would appear that the majority of fault lies with the truck driver who pulled out and caused the initial collision in violation of California Vehicle Code 21804. However, there MAY be some fault attributable to you for either following too closely (California Vehicle Code 21703) and/or traveling at an unsafe speed (California Vehicle Code 22350). Report this to your auto insurance carrier immediately if you haven't already done so and let them sort this out.

A: The value of any personal injury claim including a bicycle accident is broken down into two basic categories as follows: (1) Economic Damages: These are the out of pocket costs associated with the incident. They include the reasonable value of your medical expenses, lost wages from time missed from work as a result of being injured and not able to perform your job or to go to doctor's appointments, and the property damages (in this case the cost of either repairing or replacing your bike) (2) Non-Economic Damages: This is compensation for both the physical pain associated with your injuries and the emotional distress related to being hit by a car on your bike. It is also meant to compensate you for the disruption the incident caused to your daily activities like work, home chores, exercising, leisure activities, etc. While Economic Damages are fairly easy to calculate, general damages can be maximized by providing information on what the incident caused you to undergo. An experienced bicycle accident lawyer knows what these cases generally settle for and can advocate for you to maximize the value of the claim.
Q. When 3 people in same car accident and one is more Sirius hurt than the other two what is the outcome of that
A: Unfortunately, insurance companies don't want to settle claims "piece meal". They want to have a settlement that includes all people making claims. I would suggest retaining a personal injury attorney if you don't have one and asking them what can be done to expedite the claim.
