I attended law school in my mid 30s after earning my degree in speech communications, traveling a bit, waiting on tables, running a small food business and teaching tennis for eight years. Translated, I had a bit of a life and a well developed personality and world outlook at law school, unlike so many "kids" who go straight out of college and learn only to fight. My job is to see your issues from the legal and non legal sides. I need to see how the other side thinks as well to end up with successful results.
I do not come from an ivory tower. I've been poor, very poor, for years, and whatever I have I have earned it on my own. Remembering that path and that climb is essential to everything I do, every day and why I fight for all that you deserve and usually try to get you a bit more than the law allows. - Q. Am in a middle of lawsuit for my lemon and the car got stolen a now in impound can my lawyer help me get my lemon law
- A: THIS is a different question. There is a case, Martinez v. Kia from around 2010 that came out which your lawyer should know about if s/he is any good. In the case Ms. Martinez was so fed up over her lemon car she parked it outside of the dealership and threw the keys over a locked fence. Kia repossessed the vehicle and sold it for a loss at auction. Then KIA sued Ms. Martinez for the remaining balance and she defended by using the CA lemon law. The court ruled that no car was
required to get the remedy. These days, as they try to weaken the lemon law, you may not get the same result and I make sure that all of my clients are in agreement to give the car back in a win. Hopefully, they recover ... Read More
- Q. How long after a settlement should it take to receive the settlement agreement and release?
- A: There is no rule anywhere about how long before a settlement agreement OR a release (often the same document as a settlement agreement and release) shows up for signing and in fact there is no rule requiring one, but, it's a whole lot better to have a written agreement in place for both sides. As to Lemon Law cases, my specialty, it can vary on a case by case basis like as to GM or FORD or BMW or or or, and the attorney you get? The other side DOES like to drag things on for a bit, moreso lately. It helps to frustrate even a winning consumer and it gets the bad guy attorney (for GM etc) paid more money... - A: Sorry for your issues. IF you received such a notice (hard here to tell what type of product, which can matter) they are essentially admitting ALL such products have certain issues. THIS may lead to a class action? Check the net for that to see what your rights IN the class may be and whether you do in fact still have them? Otherwise, if the issue is serious enough maybe you start a class? Cheers
