Starting as an assistant prosecuting attorney, Samuel gained valuable courtroom experience before transitioning to private practice.

There, he focused on assisting small businesses with transactional matters and litigation, while also offering services in estate planning, probate estate administration, and Medicaid planning.

As Samuel’s family law practice grew, he later joined a nationwide family law firm, where he refined his skills in divorce and family law over the better part of a decade. Part of an in-house litigation team, Samuel not only presented and taught clinics on evidence, cross examination, and other trial techniques, but Samuel has also presented Continuing Legal Education programs for other attorneys on complex issues in family law cases and other family law matters.

Q. Is it possible to keep co-owning a house while applying for marriage dissolution in Ohio? Thanks!
A: Generally speaking, the purpose of terminating your marriage is to disentangle you and your spouse from one another, including mutual obligations related to the ownership of a home. Additionally, continuing to co-own a home after the termination of your marriage (even if through a dissolution) can open up a host of pitfalls and liabilities including but not limited to negative impact on your credit if payments are missed, the issues that arise if the spouse who retains the property defers maintenance or fails to pay utilities, taxes, and insurance and the list goes on.

While Ohio law requires the court to divide all property, it is not against Ohio law for a separation agreement incorporated into a Decree of Dissolution from awarding the marital residence/investment property to both parties. However, unless there is a very good reason for it, it is not advisable.

I would strongly urge you to seek counsel before attempting to navigate the process on your own.
