Q. Can I move to another state, at my will, if my ex is keeping our kids and I provide child support. Live in TN
A: If there is currently a divorce action pending you should seek permission from the court if you cannot work out an agreed parenting schedule for the children that provides for specifics about when you and your kids spend time together. That said, you can move without an agreement but the court may hold that against you if it is ultimately required to make a decision on the parenting schedule if you and the other parent can't agree. You don't need the other parents permission to move without the children, or the courts - they cant keep you here (but can keep the kids here). Just to work out a parenting schedule by agreement or by court order.
