- A: Hi there, in the event that you pass with an active workers' comp claim, the claims adjuster should pay to your estate the permanent disability benefits which have accrued and are unpaid. I understand that Hartford is unwilling to settle your medical, but you have other options to obtain a settlement now, including potential settlement of just the indemnity portion of your case or possible a petition for commutation. If your prior attorney is not willing to assist you with this, you should reach out to other attorneys who are members of the California Applicants Attorney Association and consult with with your local Information and Assistance officer at the WCAB.
