- Q. Is there any updates or exceptions on green-card holder’s laws after pandemic to stay abroad more than 6 months?
- A: Good morning, The 6 month rule is less a rule and more of a guideline. Especially during these times, I certainly would make sure you had information about how COVID and travel restrictions have impacted your ability to be in the US. It will come down to whether you intended to abandon your residence here so any information you can provide showing that was not what you meant to do will be helpful. Unfortunately, we have not seen any sort of clear guidance about this so the best you can do is gather as much evidence as possible in case it becomes an issue. - Q. If I was to marry my fiancé of 2 yrs who is a US citizen but is on parole, will that affects me getting a green card?
- A: Good morning, Most times it will not matter that your fiance is on parole, but without knowing specifics of what they are on parole for, no one can fully answer your question. Immigration law is very complicated so many things may affect whether you can get status through marriage. - Q. My I-485 was denied because I didn’t file I-864 along with it. In the denial letter it says Im not allowed to appeal.
- A: Good morning, Fortunately, as one of the other attorneys stated, you are only stuck in part 2 of the process so your underlying reason for being eligible still applies.
