Biography

My practice has two main focuses: aggressive litigation/trial advocacy and competent, thoughtful pre-litigation support (through risk-management, practice consulting, crisis management, and media relations). I specialize in complex civil litigation including medical/professional malpractice, civil rights, 42 USC 1983, business/commercial litigation, and employment matters. I also have experience in class action litigation, appeals, and in select criminal matters.

For my whole career, I have placed a high value on developing long, solid relationships with my clients. Being involved in litigation is an often baffling, challenging, and emotionally draining experience, regardless of whether you have been sued or have made the decision to proceed with a lawsuit against another party. I pride myself on making this complex process as straightforward as possible, and in providing true value to my clients, not only thorough outstanding advocacy and trial skills, but through clever and creative problem solving, pre-suit client support, constant communication, and importantly, the use of cutting-edge technologies.

Every matter my firm and I handle is prepared, or "worked-up" from the start in anticipation of an eventual trial. Not only do I find that forming an early trial strategy more accurately directs our pre-suit and discovery efforts, but I have found that this strategy puts my clients in the best possible position for a successful resolution of their matter. Working with full information, justified confidence, and good strategy puts my clients in a position of strength throughout the litigation process.

At trial, my reputation for success is hard-won and indisputable. In over 40 trials, I am proud of my greater than 95% success rate. While success can never be guaranteed, I ensure my clients that I will do everything within my power to put their matter in the best possible position, that no fact will be unexamined in our investigation, and that our trial strategy will be sound and honest.

Of course, avoiding litigation is an equally worthy goal of quality legal representation. I have been able to provide my clients with valuable legal guidance outside of the context of active litigation through risk-management, practice consulting, crisis management, and media relations. I have appeared on television (both local and national) numerous times representing and speaking on behalf of various clients. I have helped many professionals avoid embarrassing and costly public relations disasters by quickly and quietly acting to resolve these high profile matters in confidence. I work closely with my professional clients to evaluate their policies and practices in an effort to effectively manage the risk that is part of doing business in a litigious society. I have frequently spoken at risk management seminars in this regard, and am often called to consult by professional corporations relative to their policies, practices and procedures.

In today's competitive legal services market, it is not enough just to promise hard work and eventual success -- while an attorney must have a proven history of such results, he must also be able to deliver high-quality services at reasonable expense. My practice heavily incorporates technology to provide not only outstanding results at trial, but to effectively and efficiently share information and coordinate strategy with clients, insurance representatives, and witnesses. My focus on technology not only gives me an enormous advantage in the Courtroom, but allows my clients to realize true cost savings in litigation.

Finally, but perhaps most importantly, I also pride myself on my character and reputation as a fair, but tough advocate. As President Kennedy aptly observed, "civility is not a sign of weakness." I have long believed that my reputation as a thorough, competent, and civil advocate -- with the Courts, and in both the plaintiff and defense bar -- serves my clients well. I strongly believe that my ethics, civility, and toughness reflect the high quality of the individuals and businesses who seek my representation.
