Q. How can I apply for an L-1 visa to continue my position in the USA?
A: If you are talking about the L-1A visa, the general requirements are as follows:

1. There must be a qualifying relationship between the UK and U.S. companies (parent, branch, subsidiary, or affiliate). For example, if you own both companies, or if one company owns the other, the relationship qualifies.

2. The UK company must be operational, meaning it engages in actual business transactions.

3. The U.S. company must be, or will be, operational. If transferring to a new U.S. office, you must submit a lease, business plan, and a plan to hire staff within one year.

4. You must have been employed by the UK company for at least 1 continuous year within the last 3 years in a managerial or executive capacity.

5. Your position in the U.S. company must also be in a managerial or executive capacity.

Your U.S. employer must file Form I-129 with the L Supplement with USCIS on your behalf. Premium Processing (Form I-907) is available. Once USCIS approves the petition, you can apply for the L-1 visa at a U.S. Embassy or Consulate.
