158 Questions Answered

Q. Can a charge that was withheld adjudication be seen as a conviction on a employment background check
A: What do you mean by "withheld adjudication"? Generally, only convictions and pleas (which are convictions) show up as convictions.
Q. Ok I got a good friend is sitting in Louisville and the federal medical prison due to a parole violation since
A: You are going to have to get a ruling from the judge on the length of sentencing for VOP. He needs an attorney. He can't do it himself. If he cannot afford one, then he should ask for a public defender to be appointed or contact Legal Aid and see if he can get an attorney there.
Q. If a mother is 17 and she an unruly and assault charges what will happen to her?
A: I'm not certain that I understand the question. Why do you identify the person as "mother" if she hits her Dad? If someone files assault charges, and you are convicted, your child can be taken away. Usually, that type of action goes through the Department of Children's services.
Q. Can co-defense counsel prejudice a co-defendants trial?
A: I thought about you the other day. Allen has a billion point thing. I l'll try to talk to you later. I really wish that the Elton John thing could happen. Sincerely, Kent.
Q. First offense , first arrest . 39-17-415 possession of schedule VI . What will happen? I've never been in Trouble I'm 19
A: First of all, the Tennessee District Attorneys are very against marijuana usage, because it is a crime. If you are young, and it is your first time offence, then there may be the possibility that a good attorney could get you off of pre-trial diversion. If you could do that, then you would have a suspended sentence for a year, then you could have your record expunged. That is the best case scenario. Never go into criminal court without an attorney. You can use Avvo's Find-a-Lawyer function to find one.
Q. When you get charged with aggravated assault, then do not get bonded out, spend almost 2 months in jail. They somehow
A: If you were booked, then you had a right to be bonded out, unless you are on no bond. The 8th Amendment to the United States Constitution provides for bail. There are certain circumstances when you could be denied bail. Those generally involve violent crimes and the ability to leave the country. I would suggest that you contact a local criminal defense attorney.
Q. Hello, In 1990 I was charged with A Violation of Custody Order with no conviction. Will this felony ever go away?
A: I'm not sure if your criminal issue was in Colorado or Tennessee. I would contact an attorney in whichever state it occurred. If you were not convicted, then I think you have a chance of getting it expunged. If you were convicted or entered into a plea, then you would need to talk with your attorney.
Q. no
A: There is no crime involved with adults associating with minors, so long as nothing criminal occurs like threats, abuse, sexual acts, etc.
Q. my friend is 22, lives in TN.. she has about 4-6 friends who are between the ages of 14-17 can she go to jail for that?
A: It is not a crime to be friends with minors. Did something else happen?
