Biography

Mr. Cohen is the founder and principal of the Cohen IP Law Group, P.C. His practice involves intellectual property, business and entertainment law.

Mr. Cohen is registered to practice before the United States Patent and Trademark Office as a patent attorney and is experienced in all phases of IP litigation relating to patent infringement validity and enforceability, trademark infringement, trade secret misappropriation, unfair competition, and interference with contractual relations. He specializes in matters involving UDRP proceedings, cybersquatting, and other domain name issues, and has successfully obtained preliminary injunctions against cybersquatters.

Mr. Cohen is also active in rendering patent and trademark validity and infringement opinions in a wide range of technical disciplines. He has argued and prepared motions and briefs in proceedings before the United States District Courts, the Trademark Trial and Appeals Board (TTAB), as well as appellate practice before the Court of Appeals for the Federal Circuit (CAFC).

Mr. Cohen regularly counsels clients in entertainment transactions and IP transactional matters including licensing options and strategies, joint development, service provider and confidentiality agreements in addition to Internet-based terms of use and privacy policy statements. He is frequently retained by entertainment and business law firms to handle specialized matters involving their client's patent and trademark portfolios and to resolve infringement disputes.

Q. how would I find out if someone is using my patents.
A: Normally through due diligence, meaning knowing the competitors of your products/services and monitoring them. Once you believe they are offering the same or similar product/service, you would then consult with a patent attorney to analyze your registered patent, particularly the claims of your patent. The patent attorney would provide an opinion either oral or written as to whether or not each and every element of at least one independent claim "reads upon" the allegedly infringement product/service. For larger companies, their in-house counsel may or may not do this or they retain outside counsel, for smaller companies you would likely have to retain a patent attorney well-versed in patent infringement litigation, not just a patent prosecutor. With technology changing, AI and other advancements may assist to some extent with the analysis. But only a patent attorney licensed in the country of the infringement could render an opinion. ... Q. Can you file a patent of a structure built from Bamboo?
A: Sure as long as you meet the threshold requirements for US patents, i.e. that it is new, useful, and non-obvious. Realistically, if it is a commonly shaped teepee with no novel utility, it will likely not be enough to pass the thresholds for a utility patent application. However, if there is a special function or feature to the teepee, then that feature could be patentable. Further, if the shape is different than a typical teepee, then it is possible to consider filing a design patent assuming the shape is novel. A patent search, specifically a novelty search, can help shed some light in regards to some of these issues.
