Q. I won my personal injury case now what?
A: A collection attorney will likely work on contingency. That means they will only get paid if they collect and they will get a percentage of what they collect. My office regularly handles matters like this and would be happy to review the case. Please feel free to contact us to discuss this matter further. 203.870.6700
Q. If I have 110,000 in a 401k is that exempt and how do I put it on the form
A: If you are not working with a bankruptcy attorney, you are misguided. Bankruptcy has a steep learning curve and too many moving parts for even a non-bankruptcy attorney to handle properly. You should consult with an attorney with a primary focus on bankruptcy like the attorneys who have answered you here. Its easy for us to tell you to schedule your asset on B and exempt on C and that you should have an unlimited exemption to cover it. Its another thing to explore every little idiosyncrasy etc. and every item in your petition. You do not want to make any mistakes. A good bankruptcy attorney will charge between 2000 and 2500 most likely. You would do well to explore those options. Otherwise its like trying to change your transmission without a mechanic and having no mechanical know-how. You will end up with a giant paperweight. Good luck.
Q. I attended a Bruce Springsteen concert years ago. He shouted, “Is there anyone alive out there?” Crowd cheered.
A: I would imagine that the phrase is not copyrighted or trademarked and if there was a concern, you could likely say that it was under the “fair use” exception, seeing how it is short and not very original. I used to do standup comedy in NYC and often called out something similar. I would not worry.
Q. My husband and I filed a Chapter 13 bankruptcy in 2005. The bankruptcy was discharged in May 2010.
A: Did you agree to pay the second mortgage through the Chapter 13 plan? If yes, then you need an attorney to put the mortgage company on notice and possibly review other options available to you. There may be an FDCPA (Fair Debt Collection Practices Act) case here against the debt collector too. If this was not in your 13, you likely still owe it and need to take care of it. Good luck.
Q. New hamspire based broadband company leaves work equipment on street in front of house and there is a impending storm.
A: From what you have described, you should have no liability or duty to protect this equipment.
Q. I'm filing a emergency bankruptcy paperwork and I was wondering if I can extend the two period
A: You need to file a motion for the extension and if you are doing this without an attorney, you are going to be very ill-equipped with the rest of the filing. I highly recommend hiring an experienced attorney with a focus on bankruptcy. This is not the kind of legal matter that a lay person can handle on their own.
Q. can I sue a doctor for misdiagnosis and wrong treatment?
A: You have no permanent injuries and any misdiagnosis does not seem to have disadvantaged you in your medical treatment in any meaningful way. Thank goodness you switched doctors and trusted your instincts. Now if your new doctor states that you are suffering and may continue to suffer due to prior treatment with your old medical provider, you may have a case. However, based on the information you have provided, I don’t think this is worth pursuing.
Q. Arrested for shoplifting Oct 12 promise to appear Oct 16..no finger printing jail etc...the AMT is for $167 1st time
A: You can either hire an experienced attorney to speak on your behalf and take care of the matter or you can speak with the state’s attorney before the hearing and explain your situation (Succinctly) and offer to do community service and ask for a withdrawal or nolly of the matter. Don’t panic. This is not a huge deal. Good luck and remember it will all work out. This is a minor speed-bump in the highway of your life.
Q. Can a job offer be revoked due to me being a medical marijuana patient in Connecticut (not gov't job)?
A: Pursuant to a recent federal district court case (Noffsinger v. SSN Niantic Operating Co. LLC,) Connecticut employees who have received approval from the state agency to use medical marijuana outside of work cannot be fired just because they test positive for marijuana during a drug screening. The court also held that employees and job applicants can sue based on a termination or a rescinded job offer. If you are interested in further information, please feel free to contact us. Thank you.
