- Q. Can I legally remove my adult stepdaughter from my house in NJ?
- A: Assuming that she does not pay you rent, you would need to file an ejectment action. It is quicker than eviction. Rent is defined in the very broadly so I would need to conduct an a consultation with you by phone for in person to figure out if this is the proper route. From what I read in your question it probably is.
- Q. Options for evicting non-lease occupant despite restraining order and job risk in NJ?
- A: What is the nature of the relationship between the employer and your friend? My initial thought is that he moves by ejectment. I would just like to clarify what is the legal relationship is between the employer, your friend in the apartment.
- Q. 40 year old pays no board and trashes home
- A: The short answer is yes. For the purposes of the answer I am assuming the person involved pays no rent and never has. You would need to file an action called and ejectment. And ejectment is used for trespassers, guests who have worn out their welcome, and similar people. If the person is pay the rent as any point during his stay you have to go through the eviction process.
I am somewhat confused by the language about making him pay. As noted in the above if the person in question has paid rent and then stopped and you want to recover lost rent or other damages you would have a different action in a different branch of the court. Eviction actions just determine possession of the property.
