He received his undergraduate degree in economics from Boston College and later graduated from law school at the University of Arizona. Matt Maerowitz’s practice focuses on DUI, criminal defense, and personal injury cases. Before co-founding the Maerowitz Law Firm, LLC, Matt worked for a Scottsdale law firm where he drafted numerous criminal defense motions, primarily in DUI cases. Matt also worked for the Pima County Attorney’s Office as a student-prosecutor during law school where he handled several trials. Matt’s experience with both sides of criminal law cases has helped him anticipate arguments from the prosecution in order to prepare the best defense for his clients.

- Q. Is there any way to remove this from record?
- A: The charges other than the one/s you plead guilty to should show up as dismissed. You can set aside any convictions after completing all terms of your sentence. If you don't want the case to be visible at all, you can request to seal your records. Normally the court will have information on a petition to seal. There are several requirements that have to be met including a waiting period after all terms of sentence are completed before the Court will seal case records.
- Q. In Arizona is it legal to use a blood sample drawn 2 1/2 hours after being stopped?
- A: Generally, the law does not require blood to be drawn within 2 hours. I think you are confused with particular alcohol-related DUI charges, which require the State to prove alcohol concentration within two hours. As a result, officers are supposed to draw blood within 2 hours of driving or actual physical control, but this cannot always be done and it is not necessarily illegal to draw outside of 2 hours. Even a blood draw outside two hours, an alcohol concentration (normally in the form of a range) within 2 hours can normally be done with expert testimony. It is possible there are issues with the retrograde or other issues with the blood, which you should discuss with a lawyer about.

- A: You will need to handle the DUI in AZ and should consult a DUI lawyer immediately. If the court was unable to serve you, then the Court likely issued a warrant for you arrest. Many lawyers offer free consultations. If you cannot afford a lawyer, one will be appointed to you because DUI in Arizona carries mandatory minimum jail.
