Attorney Mary T. Rogers won a United States Supreme Court case as co-counsel on June 25, 2009. The case, Melendez-Diaz v. Massachusetts, has widespread application to all criminal cases throughout the U.S. The Court ruled that under the Sixth Amendment all defendants have the right to confront and cross-examine forensic crime analysts. The government cannot rely on the forensic lab report in place of live testimony. Now, the government must call the live witness to the stand.
On February 3, 2010, Attorney Rogers succeeded in having Mr. Melendez-Diaz granted a new trial. On February 10, 2011, after a retrial in which Attorney Rogers assisted Mr. Melendez-Diaz was found not guilty.
