- Q. If someone hits my car and we both leave where wreck happened can they charge my insurance
- A: NM law requires both parties to stay at the scene of the crash and exchange information--driver's license and insurance. Sounds like you might have exchanged information. Also sounds like no law enforcement showed up to investigate.
Any person can make a claim against your insurance, but the insurance will deny the claim if not your fault. The other person will need to show that you were the cause of the crash. Keep in touch with your insurance company. They would be the best source of information of why they believe or don't believe the crash was your fault.
- Q. Can my attorney abandon my case 2 months before statute of limitations runs out?
- A: The communications before the termination and immediately after the termination are really important in determining whether you have a legal malpractice claim in NM. An attorney has the duty to keep the client updated on matters related to the claim the lawyer is handling for the client. It would seem to be improper to terminate you just 2 months before the three year statute of limitations. Perhaps a better course of action for the attorney would have been to actually file the lawsuit with the understanding that you would need to find a new lawyer rather than abandon you.
- Q. I was told by my auto insurance agent that uninsured motorist coverage in NM is portable, is that true?

Yes, uninsured and underinsured motorist coverage is portable. For instance, if you own a Ford and a Chevy it would work like this. You could buy uninsured motorist coverage on the Ford and not on the Chevy. If you are in an accident with an uninsured driver, you would also receive uninsured motorist coverage on the Chevy.
