- A: Yes, there are various pretrial diversion programs that might be applicable to the case, as well as other favorable outcomes for the defendant. Depending on what the evidence shows and what is compelling to the prosecutor on the case, this may even be a case that merits dismissal.
- Q. I overheard my court appointed attorney calling me a liar to the DA when I was sitting in court today waiting for him
- A: You need to hire a private criminal defense attorney. The attorney you hire will be able to replace your appointed attorney. There may be some damage done to your case by the original counsel, but that’s something for the new lawyer you retain to deal with as appropriate.
- Q. So the judge can set the amount of bail to what he wants. Is There's no legal limit??
- A: Bail is set using various guidelines, which vary a bit between jurisdictions. The bail amount has to be reasonable when considered in light of the severity of the crime, but bail will also be higher if the defendant has a substantial criminal history, especially one that includes bail jumping. Bail is meant to ensure that a defendant isn’t going to be committing more crimes while out of police custody and that the defendant will come back to court when summoned, so the amount factors those issues in.
