Biography

Luigi Vigliotti is a former New York State Prosecutor and a seasoned criminal trial lawyer who focuses his practice on criminal law with a particular emphasis on DWI/DUI defense as well as general vehicular criminal defense.

While in the District Attorney’s Office, Mr. Vigliotti was assigned to the prestigious DWI/DUI unit where he successfully prosecuted thousands of vehicular cases involving DWI/DUI, leaving the scene of an accident, breath test refusals, driving under the influence of drugs, driving under the influence of alcohol and drugs, driving while ability impaired, hit and run and countless other crimes. He also prosecuted a variety of Misdemeanor and Felony cases, tried several Misdemeanor and Felony jury trials to verdict, conducted scores of pretrial suppression hearings, presented Felony cases to the Grand Jury for indictment and handled a wide array of criminal cases from Arraignment to Trial.

In 2008, Mr. Vigliotti started his own law practice where he focuses the bulk of his efforts on the defense of all criminal matters and personal injury litigation. Mr. Vigliotti has also been active in teaching trial advocacy to law students. He has been asked several times to teach at Hofstra Law School’s Trial Advocacy program courses.

Mr. Vigliotti is a former traffic prosecutor at 801 Axinn Ave (formerly 16 Cooper Street, Hempstead) and handles both simple and complex traffic matters from arraignment to trial.

Q. How do I know if I have any open criminal cases? or if I am under investigation? I am out of US but want to return.
A: I'm going to assume that this inquiry relates to a New York State criminal matter as opposed to a Federal matter. As to whether you are under investigation, you probably will not find out the answer to that question. After all, if you're being investigated, the investigation is likely to be secretive and you may not know about it until you are arrested. If it's a felony, the local prosecutor may have convened an investigative Grand Jury panel and if an indictment has been voted, you won't necessarily know about it until you are arrested and the indictment is unsealed. As to whether you have an open criminal case, normally one could access the Court's e-file system (Webcrims). If you've been arraigned on a criminal charge and the matter was never resolved, you likely have a bench warrant out for your arrest. If that is the case, contact a local criminal attorney and arrange to have the warrant recalled by your appearance in court. When you speak to that attorney, find out whether bail is likely to be set. Although many charges these days are no longer bail eligible, if one fails to return to court, an otherwise bail ineligible charge may nevertheless result in the imposition of bail. Q. My granddaughter’s father was issued a restricted drivers license for a DUI & he is telling me that he can drive w baby
A: Is the question whether your grandfather can drive with a baby while possessing a restricted license? If so, I don't believe that your category of license ever restricts your passengers. In other words, I'm fairly certain that as long as he possesses a license, he can drive. Whether his passengers are adults or children is not limited by the type of license he possesses.
Q. , how can I change an independent attorney that is NOT serving him/her
A: You should hire someone new if you are not satisfied with your current lawyer. If your attorney is legal aid or 18b, you can ask the court to consider giving you a new lawyer.
