I have been in practice since 2001. I have devoted my career to criminal defense work. In 2013, I obtained certifications from the National Highway Safety and Patrol (NHTSA). I am a certified NHTSA instructor and have instructed attorneys as well as law enforcement in Standardized Field Sobriety Testing. I also hold certificates in Advanced Roadside Impaired Driving Enforcement (ARIDE) training, and Drug Recognition Training (DRE). While my firm handles all types of felonies and misdemeanors, I have concentrated my efforts on drug and alcohol defenses. Due to my extensive knowledge in these fields, I am known as the OVI Queen. I am in good standing with the Supreme Court of Ohio and am an active member of the Ohio State Bar Association. I also hold certificates for the United States Court of Appeals for the Sixth Circuit and am licensed to take federal cases in the Federal Court for the Northern District of Ohio.

Q. A 16 yr old boy and 15 yr old girl are dating, and have been dating for almost 11 months. When he is 17, is it illegal?
A: Dating or having sex? Dating is not illegal at that age, obviously we are assuming parents are ok. However, when the young man turns 18, she will be turning 16, I am presuming shortly after…It would not be statutory rape because she is 16 (the age of consent). If she is 15 then it would be considered statutory rape.
Q. Hi there... I got caught shoplifting at giant eagle and the theft loss and prevention guy stopped me.
A: Hello. If the police got a good picture to capture the license plate, then I believe the person that owns that car will be getting a visit from local law enforcement. If you need an attorney please feel free to call Attorney Linda Malek (330)819-8018 or Attorney Chris Vogt (330) 703-6467.
Q. I live in Stark Co, Ohio. In 2016 I was convicted of a felony 5 , drug possession of heroin charge. One other misdemeang
A: Hello. No, your gun rights are not automatically restored once they have been disabled. You would have to petition the courts to have your rights restored, and must demonstrate to the Court that you meet the requirements to have your rights restored. Please remember that sealing and expungement are 2 different things. You can get something sealed before you can get it expunged. Felonies that are of the 4th and 5th degree may be sealed after one year and Felonies in the 3rd degree would take 3 years after discharge. However, to expunge these offenses takes much longer. It takes 11 years to expunge 4th and 5th degree felonies, and, and for 3rd degree felonies it would take 13 years to apply. It is not likely that your crime was sealed AND expunged at the same time. You will have to fill out another background check and the court and law enforment will have access to items that others won’t. Be mindful of that. I hope this helps you!! If you have questions or need a lawyer, please feel free to call Attorney Linda Malek or Attorney Chris Vogt at 330-703-6467 or 330-819-8018. ... Read More
