Q. Concern about settling car accident case before surgery due to limited insurance coverage.
A: To begin, you should discuss this issue directly with your attorney. Settling a case before surgery can be risky because once you accept the $50,000 policy limit, you cannot seek more from that driver even if your medical bills later exceed that amount. In Florida, your Personal Injury Protection (PIP) coverage will pay up to $10,000 for medical expenses, and if you have Medical Payments (MedPay) coverage, that can help with bills as well. You should also explore whether you carry uninsured/underinsured motorist (UM/UIM) coverage, which can provide additional compensation when the at-fault driver’s limits are inadequate. A settlement should account for all of your medical needs, so make sure your attorney explains how PIP, MedPay, and UM/UIM coverage fit into your case, I'm sure s/he would be more than happy to discuss your concerns with you. ... Q. Will a lawsuit settlement impact my SSI benefits in Florida?
A: Yes, a lawsuit settlement can impact your SSI benefits. SSI is a needs-based program, so any settlement or award you personally receive will generally be treated as income in the month received and as a resource after that month. This can reduce or even suspend your SSI payments, and it can also affect your Medicaid eligibility since Medicaid is tied to SSI in Florida.

That does not necessarily mean you should remove your name from the lawsuit. In many cases, a settlement can be structured through a special needs trust or other planning arrangement so that you still receive the benefit of the recovery while preserving your SSI and Medicaid. Removing your name could forfeit your right to compensation and may not protect your benefits the way you hope.

You should consult directly with an attorney who understands both personal injury litigation and special needs/Medicaid planning so that any recovery is handled properly.

Q. How to ensure my business is compensated for damages after a car crashed into it?
A: You have already taken important first steps by securing a police report, video evidence, and witness statements. To ensure your business is compensated, you should promptly notify both the driver’s auto insurer (for property damage liability coverage) and your commercial property insurer (for building and business interruption coverage, if you carry it). The plaza or building owner’s insurer may also be involved if there are issues with the structure itself.

Compensation can include repairs to the property, replacement of furniture and equipment, and lost income during the time you are unable to operate. If the driver’s policy limits are not enough, your own insurance may provide additional coverage.

Because multiple insurance carriers may become involved and each has an incentive to minimize payouts, it is important to work with an attorney experienced in property damage and business interruption claims. They can coordinate the claims, document your losses, and make sure you pursue all available sources of recovery.
