Q. Is it legal for my employer to question my job suitability due to FMLA needs?
A: It is illegal for your employer to take any type of adverse action against you because you used FMLA leave. Any such adverse action would constitute FMLA discrimination. The comment from your boss is way off base, and you should strongly consider raising this with HR, if you have not already done so.
