- Q. Is it illegal to be unknowingly videotaped during sexual encounters without consent?
- A: In Virginia, it is a criminal offense for a person to photograph or video a person when they are nude or in a state of undress without their consent. Likewise, it is a separate criminal offense to disseminate those images or videos without the person's consent.
Based on your question, it appears that the person who video taped you without your consent violated Section 18.2-381.1 of the Virginia Code. If they have shared the video, they likely also violated Section 18.2-386.2 of the Virginia Code.

- A: Under Virginia law, recording a conversation is legal so long as one person in the conversation is aware and consents to being recorded. Therefore, it is legal for your mom to record conversations between her and you, even without informing you of the recording. Likewise, it is legal for your mom to record conversations between her and your dad, even without informing your dad of the recording.
