A: Hi - I'm so sorry for your loss, that is awful. There are many factors that may permit you to initiate a suit. You can call an attorney to get some more insight as well as a referral to an attorney in your area.
Q. Does my band need to have an internal band contract? Should we consult with an attorney about that?
A: Hi - you need to think of your band as being similar to a marriage. If there are assets (equipment, recording contract or incoming revenue streams), and there is a breakup, there are going to be disputes on how the assets will be split up. If you are in that position, congrats! That indicates that you are seeing some success with your endeavor. However, it would be prudent to have an agreement between the members that solidifies what would occur if there was a break-up, etc. It can also include how royalties and other properties would be split in the normal course of business. In essence, you would have a partnership agreement that would lay out a foundation for the legal aspects of the band. Good luck! Jon

A: Hi - if they are threatening a warrant, there is a good chance you are going to be charged with a violation of the law. They are most likely attempting to speak with you prior the charge(s) being filed in order to get a statement from you, which can only hurt you at this point. Once charges are actually filed, your right to counsel automatically attaches to the situation, and the police would not be permitted to speak with you. I would highly suggest you retain counsel in order to speak on your behalf and handle any warrant (if it's issued) and surrender to the court.
Q. Question my daughter n law has a permit got a ticket for failure to keep right what happens she has a permit
A: Hi - so sorry to hear about her ticket. If she has a permit, or is a junior driver, a conviction for that ticket will result in her permit being revoked. You should seek counsel in order to attempt to get the ticket reduced to a non-moving violation, which will not have a negative impact on her status. Good Luck! -Jon

A: Hi - New York has never had the ability to get a criminal conviction sealed absent a drug diversion program. However, in the near future, you may be eligible for sealing under a new statute that will be effective in the fall. Feel free to call the office to discuss further.
