- Q. Can a minor in CA be served a summons for a court collection account?
- A: It is not valid service.
But do not ignore the lawsuit. While you could file a motion to quash service, it is often not worth fighting. Consult with experienced debt collection defense attorneys.
Note, You must respond in the legal way and on time with, for example a motion or an answer with affirmative defenses. Failure to do so could result in a default judgment against you.
- Q. Experienced vision loss after improper dilation at eye exam; want changes in medical practice.
- A: Where there is a breach in the medical standard of care there may be a malpractice case. Malpractice means that a doctor violated the standard of care. A bad outcome is not enough. Another doctor would be needed to evaluate what the doctors did.
In addition to damages for the harm caused, a party may seek a change in procedures.
- Q. Do I have a legal case for botched knee surgery in Nevada?
- A: Yes, yes there may be a malpractice case. To prove malpractice it must be shown through expert testimony that the doctor acted below the standard of care. Another doctor of the same specialty would have to review the records to determine what can be proven.
There are many other issues that have to be evaluated to determine the case’s viability. In your particular situation, you should consult with an attorney right away due to the strict time deadlines for filing malpractice cases. In Nevada, the law recently changed from a one year time limit to a two year time limit. The two year time is not retroactive.
