That’s me, Jo Belasco, Esq., in the picture with one of my horses, a Mustang mare named Reboot. You won’t see many pictures like that as an attorney profile picture, but I’m not your average attorney. I know that a lot of people are afraid of attorneys and the law. I believe the law is a tool we can use to enrich our lives. My job is help you understand the law and use it in a way that helps you.

I do my job by explaining the law to you, not talking down to you or making you feel intimidated by it. One of my favorite things to do is make the law understandable and accessible to you. You shouldn’t be afraid of the law, and you certainly shouldn’t be afraid of the lawyer helping you. I have been an attorney since 1993 so I have the legal knowledge and experience you need and want in an attorney.

My law firm, Windhorse Legal, PLLC, is entirely virtual. I work with you via phone, email, or Skype. I practice estate planning, elder law, trademark law, and business law (including business formation and contracts). I do not do any litigation. Q. Can a foreigner file for trademark in us?
A: A foreigner may file for a US trademark but they must use a US attorney to do so. The legal fees are going to vary by attorney, and the federal filing fees will depend on how many marks are filed and in how many classes.
Q. what's the first step to acquire an abandoned trademark?
A: Your first step should be to have a trademark attorney assess why it was abandoned. For example, it might be that the Examining Attorney for the USPTO issued an Office Action that the applicant did not think he or she could overcome. If that is the case, you may not be able to get the trademark registered either.
Q. I was contacted by someone who says they own the trademark to a brand that I have been using since 2008. They filed 2015
A: If you didn't file a federal trademark registration, then you may have some common law rights. However, those rights generally will only protect you in your geographic area, not in the entire country, which is covered by a federal trademark. You should consult an attorney to decide if you only need your trademark rights in your geographic area and what steps to take with the trademark owner. If you run your business for the entire country, such as an online business usually does, then you will probably have to rebrand and file for federal trademark protection. As with most situations, it's important to discuss the matter with an attorney who can get all of the specific details from you and then provide you with your options.
