Biography

I earned my law degree from Southern Illinois University in 2002, and have 2 decades of experience practicing law. For the first 14 years, I practiced criminal law, growing a very successful solo-attorney practice and gaining extensive courtroom and trial experience. However, as I grew as an attorney, I realized that my interests drew me to a different type of practice. This is where the idea for INTELLEQUITY® was born.

Based on this new interest, I took a few advanced law courses in intellectual property at John Marshall University Law School in Chicago, Illinois. Upon relocating to Portland, Oregon in 2017, I earned my MBA at Portland State University to better help me to understand and assist my clients’ with their business needs.

My recent experience includes trademark, copyright and other intellectual property-related services, business formation and business law. I am licensed to practice in state and federal court in Oregon as well as federal court in the Northern District of Illinois.

Q. Signed a contract to buy windows, the following day, an addendum for financing. When does 3 day cancellation start?
A: I am providing a qualified piece of information here because you have not specified what type of contract it is (Home purchase, condominium purchase, car purchase, something else?).

Assuming this is a home purchase you speak of, Oregon generally provides for the right of rescission on a home sales contract by the purchaser delivering a written notice of cancellation before midnight of the third business day after the receipt of the required written disclosure from the residential property owner(does not include weekends or holidays). Upon proper cancellation notice, all earnest money or deposits must be returned to the person who provided them.

If this is a condominium purchase, the purchaser generally has a right to cancel the sale within five business days (excluding Saturdays and holidays) after the latest of several specified events within the statute, such as signing the sales agreement or receiving the required disclosure statements.

Q. I need a legally binding contract that allows me to get my eggs from the chickens that I give away to someone
A: You can definitely create a contract. Although, if you are giving all the money from the sale of the eggs to the other party who gave you the eggs, I am not quite sure the purpose of the relationship.

Q. Can a store be liable if an employee consents to watching a customer's belongings and the items are stolen?
A: If the store was negligent for failing to properly train and supervise its' employees, or not implementing adequate policies to secure the customer's belongings, that store could face liability. Generally, the store will be liable if the employee's actions were within the scope of their employment, the store failed to properly train or supervise the employee, or the store did not take reasonable care to keep the premises safe for customers.

Having said that, there is usually not a clear answer to the question of a store's liability for an employee agreeing to watch a customer's belongings and the items being stolen. Especially considering the fact that the hypothetical company posted a sign indicating as such. This could lead to a finding that the employee was not acting within the scope of his/her employment, which might negate liability on the part of the company.

Unless the property was extremely valuable, this may not be a matter worth pursuing in court, as it may cost the hypothetical customer much more to bring to court then it would to replace the item and there will be no guarantees of recovery.
