I have been an attorney since 1992, and am also a licensed Realtor. I started in California, and moved to Missouri in 2005. Q. If I agree to sign a Quiet Title with the Stipulation of leaving the house, do i still owe my half of Mortgage?
A: The short answer is yes. Your agreement with your ex is just between the two of you and is not binding on the mortgage holder on the property. You will remain bound on the mortgage until your ex refinances the mortgage or sells the property. I suggest you put your entire agreement in writing, and include a date by which your ex will either refinance (to put the mortgage in her name only) or sell the house.

Where real estate is involved, it is worth it to hire an attorney to put your agreement in writing. I strongly recommend you do so.
Q. I own a home in Missouri. My mother gave me the money to purchase my home. Only my name is on the title.
A: The short answer is that your wife's signature will be necessary to sell the house. Depending on the circumstances, she may or may not be entitled to "block" you from selling the house, but her signature will be necessary because of your marital status.
Q. My Big Brother Todd Passed Away April 8,2023 My Other Brother and I Took Todd off of Life Support! WE All Thought I Was
A: I am very sorry for your loss. You really need to consult a probate attorney to get the big picture on Todd's estate, particularly since you are unable to locate a will. Generally speaking, the POD account transfers to you automatically. But that has nothing to do with any real estate he owned. To transfer real estate you will have to start a probate. A probate attorney in your area can help you through that process.
