Biography

I attended the University of Michigan in Ann Arbor and received a degree in political science in 1986. I attended Wayne State law school in Detroit Michigan and graduated in 1989. I have practiced law for more than 35 years exclusively representing clients in the field of personal injury. I have had more than 100 jury trials since becoming a lawyer and obtained multiple verdicts that exceeded 1 million dollars including a verdict that exceeded 5 million dollars. Our law firm has a reputation as being very ethical and a reputation for achieving great legal results on behalf of our clients. I treat all my clients respectfully and make a great effort to keep them informed and most importantly I return their phone calls. On a personal level, I enjoy attending sporting events, spending time with my family and my animals. I enjoy representing individuals who need an advocate and the opportunity to improve their quality of life where they have been harmed as a result of the negligence of a third party.

Q. if I opt out of PIP, am driving my own vehicle and am in an accid can I receive wage loss benefits from the at fault dri
A: Hi,

You would still be eligible for wage loss benefits from your auto insurer even though you opted out of medical coverage under your policy. The only exception would be if you were older and opted out of wage loss coverage. Usually this would apply to individuals who are retired and are out of the work force. You could also claim replacement services even though you do not have auto medical coverage. The at-fault driver would be responsible for paying your accident-related medical expenses. MACP would not apply to you because you have no-fault coverage and opted out of medical.
Q. What are my options. A garbage company hit my parked car while I was at work. I don't have insurance
A: The insurance company for the garbage company should pay for the damage if your vehicle was lawfully parked. You should get an estimate for the damage and also submit photographs. The insurance company may also require a police report be filed. You should report the incident to the garbage company and ask for their insurance information as soon as possible.
Q. We are an s-corp LLC being sued by a customer for "incomplete project and job services" and "secondary loss"
A: Small claims court in Michigan involves cases in which the amount in controversy is less than $7,000.00 so that is the maximum amount they could sue your business under the rules. There is no reason why you could not file a counter-lawsuit seeking damages for the additional services that you provided the customer. Also, hopefully the customer signed off on a written form after the final walk through when the job was completed. You would want to provide this as evidence in your case. You could hire an attorney who handles contract cases and have the case removed to district court where the homeowner would likely need to hire an attorney at additional expense. If you have a court hearing, make sure to have your witnesses available to testify that the work was properly performed and any documentation such as e-mails showing that the homeowner is being unreasonable in their demands at the hearing.
