- A: Sorry you are going through this and facing divorce. It sounds like it would be uncontested if you are able to reach an agreement regarding the house. Since its marital residence you are each entitled to half unless there is a prenuptial agreement or other document you didnt mention. Assuming she will agree to be bought out that is something that can be done and a quit claim deed prepared so she signs title to you as part of the final judgment of dissolution. If she is not in agreement, but cant pay the house this may be something to bring up to the Judge to show you can afford it and can pay it and are making a claim for it. - Q. Commercial tenant in Florida faces rent and tax issues despite lease terms on escalation limits.
- A: 25% increase is outrageous and may clearly cause you to default. It does not sound like the landlord is abiding by the terms of the Contract. However, to be sure, the best way is to send the Contract to a real estate lawyer. Once we review it, we can advise if in fact there is a clause that caps or limits the increases and what other terms pertain to the rent. Perhaps there is one clause that cancels this out, but not sure till its reviewed. If the landlord is in breach and the rent cant be increased, then you have the right to continue to pay the regular rate.
